(b) II and III

(c) I and IV

(d) None of the above statements is correct

Answer: (a) III only

Explanation:

The Lokpal and Lokayuktas Act, 2013 provides for the establishment of the Lokpal at the Union level to inquire into allegations of corruption against certain public functionaries. The law aims to strengthen transparency, accountability, and integrity in public administration.

Statement 1 is incorrect.
The Lokpal and Lokayuktas Act, 2013 applies to public servants both in India and outside India. This means the Lokpal has jurisdiction over public servants posted abroad as well, such as Indian diplomats or officials serving in foreign countries. Therefore, any claim suggesting limited territorial jurisdiction is incorrect.

Statement 2 is incorrect.
According to Section 3 of the Act, the Chairperson or any Member of the Lokpal cannot be a Member of Parliament or a member of a State or Union Territory Legislature.
The Act further provides that the Lokpal shall consist of a Chairperson and Members, of whom the Chairperson must be:

  • a serving or former Chief Justice of India, or
  • a serving or former Judge of the Supreme Court, or
  • an eminent person with special knowledge and experience in fields such as anti-corruption policy, public administration, law, vigilance, finance, or management.

Thus, any statement contradicting these provisions is incorrect.

Statement 3 is correct.
The Act clearly states that no person below the age of 45 years is eligible to be appointed as the Chairperson or a Member of the Lokpal at the time of assuming office. This age requirement is intended to ensure maturity, experience, and credibility in the institution.

Statement 4 is incorrect.
The jurisdiction of the Lokpal does extend to the Prime Minister, but with important safeguards and exceptions.
Under Section 14, the Lokpal cannot inquire into matters involving the Prime Minister that relate to:

  • International relations
  • External or internal security
  • Public order
  • Atomic energy and space

Moreover, an inquiry against the Prime Minister can be initiated only if a full bench of the Lokpal, consisting of the Chairperson and all Members, considers the matter and at least two-thirds of the Members approve such initiation. Hence, any statement suggesting unrestricted jurisdiction over the Prime Minister is incorrect.

Answer: (a) III only
